These Terms of Service govern your access to and use of the Aureon Medical website, products, software, digital services and all related business activities.
By accessing this website, placing an order or using any of our products or services, you agree to be bound by these Terms of Service. If you do not agree with these Terms, you should discontinue using this website and refrain from placing orders.

3. Scope
These Terms of Service apply to every interaction between the customer and Aureon Medical, including the use of this website, requests for quotations, purchases, sales agreements, software licences, digital products, ACI services, Aureon FIX services, medical equipment, spare parts, accessories and all other products or services supplied by Aureon Medical.
4. Business Customers
Aureon Medical primarily supplies professional customers, including hospitals, clinics, healthcare institutions, repair centres, distributors, medical companies and other qualified organizations. Where mandatory consumer protection legislation applies, statutory consumer rights remain unaffected.
5. Products
Aureon Medical strives to ensure that all product descriptions, specifications and images are as accurate as reasonably possible. Product photographs are intended for illustrative purposes and may differ slightly from the delivered product. Colours, packaging, accessories and appearance may vary depending on availability or manufacturer updates.
Unless expressly stated otherwise, used products may show normal cosmetic signs of previous use.
6. Used Medical Equipment
Used medical equipment may display signs of wear consistent with previous professional use. Unless otherwise agreed in writing, used products are supplied in accordance with the condition described at the time of sale and are visually inspected prior to shipment. Unless specifically stated, manufacturer warranties do not apply to used products.
7. As-Is Products
Products described as "As-Is", "For Parts", "Repair", "Donor Unit" or "Untested" are supplied without operational warranty. These products are intended for repair, refurbishment, evaluation or spare parts only. By purchasing such products, the customer acknowledges the associated risks and accepts full responsibility for their use.
8. Product Availability
All products are offered subject to availability. Aureon Medical reserves the right to refuse orders, limit quantities, discontinue products or modify specifications, pricing or availability without prior notice whenever necessary.
9. Pricing
Unless otherwise stated, all prices are exclusive of shipping costs, customs duties, import taxes, brokerage fees and applicable VAT. Prices may be changed without prior notice.
10. Orders
Submitting an order constitutes an offer to purchase. A binding agreement is concluded only after Aureon Medical has accepted and confirmed the order. Aureon Medical reserves the right to reject or cancel any order where appropriate.
11. Payment
Accepted payment methods are displayed during checkout or specified in the quotation. Ownership of all supplied goods remains with Aureon Medical until payment has been received in full.
12. Shipping
Delivery dates are estimates only and cannot be guaranteed. Aureon Medical shall not be liable for delays caused by transport companies, customs authorities, government restrictions, force majeure or any other circumstance beyond its reasonable control. Unless mandatory law provides otherwise, the risk of loss transfers to the customer once the shipment has been handed over to the selected carrier.
13. Inspection Upon Delivery
Customers are expected to inspect all deliveries immediately upon receipt. Any visible transport damage, missing items or incorrect deliveries should be reported without undue delay. Failure to inspect the shipment promptly may affect available remedies where permitted by applicable law.
14. Returns
Returns are governed exclusively by the Aureon Medical Refund Policy. Products may not be returned without prior written authorization from Aureon Medical.
15. Digital Products
Digital products include, but are not limited to, software, ACI applications, dashboards, databases, licence keys, downloadable content, reports and other electronically delivered services. Once delivered, activated or made available, digital products cannot be returned or refunded unless mandatory law requires otherwise.
16. Custom Software
ACI projects and all other custom software are developed specifically to customer requirements. Once development, configuration or implementation has commenced, payments are non-refundable unless otherwise agreed in writing.
17. Intellectual Property
All intellectual property rights relating to the Aureon Medical website, software, trademarks, logos, databases, graphics, product images, manuals, documentation, source code and all other published content remain the exclusive property of Aureon Medical or its licensors. No material may be copied, reproduced, modified, distributed or commercially exploited without prior written permission.
18. Medical Disclaimer
Products supplied by Aureon Medical are intended for professional use only. Customers remain solely responsible for correct installation, maintenance, validation, regulatory compliance and intended use of all purchased products. Aureon Medical does not replace manufacturer documentation, technical instructions or applicable regulatory requirements.
19. Regulatory Compliance
Customers are responsible for ensuring compliance with all applicable laws and regulations governing medical devices, including the European Medical Device Regulation (MDR), national legislation, import and export requirements, customs regulations and any other applicable legal obligations.
20. Export Control
Certain products may be subject to export restrictions or international sanctions. Customers are solely responsible for complying with all applicable export control laws. Aureon Medical reserves the right to refuse, suspend or cancel orders where legal restrictions apply.
21. Warranty
Unless expressly stated otherwise, used products are supplied without manufacturer warranty. Where Aureon Medical provides its own warranty, the applicable warranty terms will be communicated separately and shall apply only to the relevant product or service.
22. Limitation of Liability
To the fullest extent permitted by applicable law, Aureon Medical shall not be liable for indirect, incidental, consequential or special damages, including but not limited to loss of profits, loss of revenue, business interruption, loss of production, data loss or third-party claims. Nothing in these Terms excludes or limits liability where such exclusion is prohibited by mandatory law.
23. Force Majeure
Aureon Medical shall not be liable for any delay or failure to fulfil its contractual obligations where such delay or failure results from circumstances beyond its reasonable control, including natural disasters, war, terrorism, strikes, pandemics, supplier failures, transport disruptions, governmental actions or utility outages.
24. Third-Party Links
This website may contain links to external websites operated by third parties. Aureon Medical has no control over the content of such websites and accepts no responsibility or liability for any information, products or services offered by third parties.
25. Privacy
Personal information is processed in accordance with the Aureon Medical Privacy Policy and all applicable data protection legislation.
26. Amendments
Aureon Medical reserves the right to amend these Terms of Service at any time. Updated versions become effective immediately upon publication on this website unless otherwise stated.
27. Governing Law
These Terms of Service shall be governed exclusively by the laws of the Federal Republic of Germany. Mandatory consumer protection provisions applicable in the customer's country of residence remain unaffected where required by law.
28. Jurisdiction
Where legally permitted, the competent courts of Germany shall have exclusive jurisdiction over disputes arising from these Terms of Service. Mandatory jurisdiction rules applicable to consumers under European Union law remain unaffected.
